You'd be right if this was accidental, but I'm thinking it's likely not. Stewart could have easily avoided him - he's a professional driver, so I'd imagine he'd have the required skill to ensure that a dumb kid didn't have to die for being just like him.

thats the problem even though i could care less about racing, i listen to a lot of sports radio. Stewart is known for being a hot head with an anger problem. You could make the argument that he revved his engine and tried to just get close and scare him, but then hit him. Its really tragic, but the bottom line is you should never get out of your car and start walking onto a track with racing cars on it. Like, Darwin would just face palm that shit right away. So whether he did it on purpose or not is TBD, but its a sad story either way. 20 year old kid.

Stewart won't be charged. Whether it was intentional or not, the guy shouldn't have been walking on the track. If you run across the highway and get hit by a car do you think they'll charge the driver who hit you?

Over here they will, if the driver was drunk, even if it's a suicider jumping in front of a bus/truck on the highway. But then again we have a lot even more ridiculous laws.

If the driver is drunk that certainly changes things but that doesn't apply to this situation.

Sonya can feel free to correct me if I am wrong here, but I think the laws on manslaughter are pretty similar from state to state.

There's 2 varieties, voluntary and involuntary. The voluntary kind is the "crime of passion" type deal. You know, where the guy comes home early from work and finds his wife in bed with another dude and blows both their brains out.

The involuntary type is where I believe this one would fall. It's based around the reasonable person standard. Essentially, a reasonable person in the same situation would have known or should have known their action or inaction would carry a high probability of death or serious bodily injury to another person.

Don't think that could ever stick in this situation. If anything, the dumbass who ran out onto the track during a race was the reckless one. Think about it like this.... What if it had gone the other way and a driver had swerved to avoid him and ended up crashing and dying as a result of trying not to hit him?
