the drug charges?
They don't have a case because they would need a lab test on the substance to confirm it's authenticity.
However... they have great probable cause to arrest for trespassing charges, which.. by the looks of the page... is what they are after. Sure, they have pictures of them smoking... but all that will do is make the judge more inclined to hand out stiffer penelties for the trespassing. (And should keep the DA from dropping charges do to case load and severity).
the end.
oh wait
not the end
OH AND
see, the problem is (when it comes to allowing the drugs to be legal) that when you allow the users to go unpunished, there will be higher demand for the drug. Sure, you might buy .3g of heroin at a time but you are buying it from a guy who has bricks. In doing so you support his criminal enterprise. It's somewhat like allowing people to knowingly purchase stolen property without penalty. Sure, maybe it's not sooo bad on their part but they are enabling the thief to continue business... make sense?

its all a ploy to gain more tourism.
Gambling used to be illegal in most states... look at what legalizing it did for a shithole town in the middle of the desert

Rationality clearly has no place on these boards (or in life)

Great line. But what rational person agrees with the legalization of heavy drugs? Sometimes the simple, rational answer is the correct one.
Although I think the "war on drugs" is a horrible example of combating drugs. Legalization is not the answer IMO.

(Illegal) drugs destroy families.

So does alcohol, self injury, eating disorders, etc. It is never the addiction/substance's fault. People make bad choices. Most addicts are dumbasses with no self control. You can't put the blame on drugs, but you can put the blame on stupid people who try and run from their problems by abusing a drug or alcohol, and then act like the victim at the end of the day. I think they deserve a second chance at life, but every addict out there, whether they're on drugs or not, has dug their own hole.
On topic: Dumbest thing I've seen in a while. While we all know that 99% of those people in the photos are smoking weed, there really is no way to prove it, and detaining them or testing them just for being in the pictures would probably not hold up anywhere. But whoever said a trespassing charge would hold up was most likely correct. And then from the trespassing charge, anyone questioned could probably be persuaded to admit more or take a drug test.

I don't think trespassing will hold up for the majority of the people.
That picture of the sign was recently placed up there by the police dept because of complaints phoned in to their office and emailed to their representatives.
The students have to knowingly trespass. The sign has to be clearly visible. The field is normally open to public also. It was just temp. closed to keep out the stoners.
If anyone has seen pictures of the event, there were THOUSANDS of people there. When I saw the pictures of the event. I didn't see any barricades or signs or anything that would hold up for trespassing.
How come only the students whose pictures are displayed are going to be charged? What about the other 4000 people? Somebody playing favorites with the law because they didn't have handrolled tobacco in their mouths?
This is just one big attempt at wasting taxpayers money, and I feel bad for anyone that gets suckered in to being charged with a crime and having to pay a fine\lose their scholarship.

"On 4-20-2006 University officials closed Farrand Field from 12 Noon until 5 PM. The field was closed off with barricades, yellow jacketed "event staff" personnel and police officers."
If that isn't an indication of "Closed", I don't know what is.
Im sure there is FAR more documentation of the event...
Also, not ALL of those pictures show people smoking. However, imagine you are the cop and snapping photos. You can either snap the photo of the guy NOW when he is just standing there... or wait 1 minute for him to pick up a joint. You will wait the minute. There is no such thing as "too much" probable cause.
Also... let's face it. It was 4-20 and all those people didn't show up to that field to have a picnic. Everyone knows this. I would bet very very few of the people there DIDN'T smoke. So hey... if it's just a "random sample" of the population... meh. I mean they cannot arrest them ALL (or they would have).

I didnt ask about reasonable doubt. I asked about WTF the "benefit of the doubt" principle was.
